Loan settlement questions

What loan settlement means in India, how the process works, and what it may cost.

What is loan settlement?

Loan settlement is an agreement in which your bank or NBFC accepts less than the full amount you owe and closes the account. It is meant for borrowers in genuine hardship who cannot repay in full. The lender must agree in writing, and the account is reported as 'Settled' on your credit report.

Is loan settlement legal in India?

What is one-time settlement (OTS)?

One-time settlement, or OTS, means paying an agreed reduced amount, usually as a lump sum, to close a loan or credit card. Loan settlement and OTS generally mean the same thing. A plan paid over more than three months is treated as a restructuring under RBI's 2023 framework.

Is loan settlement legal in India?

Yes, loan settlement is legal in India. Banks and NBFCs settle loans under the Reserve Bank of India's framework of 8 June 2023 and their own board-approved policies. It is not a right, so a lender can refuse. Always get the terms on the lender's letterhead.

How much do I pay in a loan settlement?

As an estimate, a settlement can reduce what you owe by 65% to 80%, so you may pay about 20% to 35%. On ₹5 lakh, that is roughly ₹1 lakh to ₹1.75 lakh. It varies from bank to bank, and your lender makes the final decision.

How does the loan settlement process work?

List your debts, gather proof of hardship and write to the lender's settlement team. Negotiate the amount, get the offer on letterhead, then pay only into the lender's official account. Finally, collect your settlement letter and No-Dues Certificate, and check your credit report for the update.

How long does loan settlement take?

Loan settlement usually takes from a few weeks to several months once a lender is willing to talk. The time depends on how overdue the account is, the lender's approval process and how quickly you can raise the money. Nobody can promise a fixed date.

What to collect after settlement

Which loans can be settled?

Personal loans, credit cards, business loans, NBFC loans and loan app dues can often be settled, because most are unsecured. Secured loans such as home or car loans work differently, as the lender can recover from the asset. Whether any loan settles is the lender's decision.

Loan settlement by bank

When is the right time to settle a loan?

Settle when you genuinely cannot repay and can raise a lump sum. Lenders are often more open once a loan is seriously overdue, and a loan generally becomes an NPA after 90 days overdue. Do not stop paying on purpose to get a better deal, because it can backfire.

Is loan settlement good or bad?

Can a bank refuse loan settlement?

Yes, a bank can refuse. Settlement depends on the lender's policy, your documented hardship, how overdue the account is and the amount you can pay. If it refuses, you can improve your offer, provide better proof, ask about restructuring, or try again later in writing.

Loan settlement vs restructuring

What is the difference between settlement and closure?

Closure means you repaid everything and the account is reported as 'Closed'. Settlement means the lender accepted less than you owed and the account is reported as 'Settled'. Closure protects your credit score far better, so choose it if you can afford to pay in full.

Settled status in your CIBIL report

What documents do I need for loan settlement?

You usually need your loan agreement, latest statement, six months of bank statements, PAN, Aadhaar, proof of hardship such as a termination letter or medical bills, and every notice you have received. After paying, keep the settlement letter, receipt and No-Dues Certificate safely.

Personal loan settlement questions

What is the personal loan settlement percentage in India?

There is no fixed personal loan settlement percentage in India, and the RBI does not set one. As an estimate, you may pay about 20% to 35% of what you owe, a reduction of 65% to 80%. It varies by lender, and only a written offer counts.

What happens if I don't pay my personal loan?

If you do not pay, the lender adds charges and reports the delay to credit bureaus. The loan generally becomes an NPA after 90 days overdue, and recovery calls and legal notices can follow. Not paying is generally a civil matter, not a crime, but it should not be ignored.

If you don't pay a personal loan

What happens if a loan is not paid for 3 years?

After 3 years, the Limitation Act generally limits when a lender can file a civil money suit, but the debt is not erased. A written acknowledgement or part-payment made in time can restart the period. The default stays on your credit report, and calls can continue.

Loan not paid for years

What is an NPA loan?

An NPA, or non-performing asset, is a loan where interest or principal has stayed overdue for more than 90 days. Before that come SMA-0 (up to 30 days), SMA-1 (31 to 60 days) and SMA-2 (61 to 90 days). NPA status brings more recovery activity and a bigger credit hit.

NPA loan settlement

Can I settle several personal loans together?

Each lender negotiates separately, so an offer from one does not bind another. List your loans by days overdue, live notices and the cheque or mandate attached, then deal with the most urgent first. A single plan across all your debts usually works better than settling them one by one at random.

Personal loan settlement service

Can I pay a settlement in instalments?

Sometimes, if your lender agrees in writing. Lenders generally prefer a lump sum. Under the RBI's 2023 framework, a settlement with a payment period of more than three months is treated as a restructuring, so ask for the schedule and the closure terms on letterhead before you pay.

What is the credit card settlement percentage in India?

How does credit card settlement work?

You separate what you spent from interest and late fees, write to the issuer's settlement team with proof of hardship, and agree a reduced amount. Get the offer on letterhead, pay only the issuer's official account, then collect the settlement letter and No-Dues Certificate, and confirm the card is closed.

What happens if I don't pay my credit card bill?

Interest, late fees and GST are added, and your CIBIL score falls as the delay is reported. Recovery calls and notices may follow if the account stays unpaid. Agents may not threaten or abuse you. Convert to EMIs early if you can, or look at settlement if you cannot repay.

Credit card bill not paid

Can I settle HDFC, SBI, ICICI or Axis credit cards?

Yes, these issuers do settle cards case by case under their own policies, though none has to agree. Legal Savvy helps with HDFC Bank, SBI Card, ICICI Bank, Axis Bank, Kotak and other card issuers. An offer from one issuer says nothing about what another will accept.

HDFC credit card settlement

How long does credit card settlement take?

Credit card settlement takes from a few weeks to several months once the issuer is willing to talk. It depends on how overdue the card is, the issuer's process and how quickly you can raise the money. Issuers are often less willing to settle in the first months.

The full process

Can I use my credit card after settlement?

No. A settled credit card is normally closed. Check that add-on cards are closed too, that no new charges appear after the settlement date, and that your settlement letter says nothing further is due. Then check your credit report for the update.

CIBIL score and credit questions

How settlement affects your credit report, and how to get a loan again.

Does loan settlement affect my CIBIL score?

Yes. A settled account is reported as 'Settled' rather than 'Closed', which lowers your CIBIL score for a period and can make new credit harder. If you can pay a reduced EMI, restructuring may harm your score less. Anyone promising no impact is not telling you the truth.

Settled status in CIBIL

How long does 'Settled' stay on my credit report?

The 'Settled' status can stay on your credit report for years, but its effect fades as you build a record of on-time payments on later credit. Beware of anyone offering to remove a true entry for a fee. Only genuine errors can be disputed with the bureau.

Improve your score after settlement

Can I get a loan after settlement?

Yes, but it is not guaranteed. RBI's framework stops the same lender giving fresh non-farm credit for at least 12 months after a settlement. Other lenders apply their own policies. Starting with a card against a fixed deposit and paying on time improves your position over 12 to 24 months.

Loan after settlement

Can 'Settled' be changed to 'Closed'?

Sometimes. Some lenders may update the status if you later pay the amount they gave up, and issue a fresh letter. It is the lender's decision, so ask in writing what it would take before paying. No third party can change this status on the lender's behalf.

Settled status explained

How can I improve my CIBIL score after settlement?

Collect your No-Dues Certificate, check that the report shows the update, and dispute any errors. Then use a small secured card, keep usage low, pay every bill on time, and avoid multiple applications. Scores recover gradually, and no one can promise a set score by a set date.

Business and MSME loans questions

Settling business loans, guarantees and secured facilities.

Can a business loan be settled?

Yes, a business loan can often be settled if the lender agrees. Check first whether it is secured, whether you signed a personal guarantee, and whether cheques were issued. Keep financial statements, GST returns and proof of the downturn ready, as lenders will look for them.

Business loan settlement

What happens to my personal guarantee in a settlement?

A personal guarantee can make you liable as an individual, so the settlement letter must say that the guarantee is released and that nothing further is due from any borrower or guarantor. If the letter does not say this, ask for the wording to be added before you pay.

Business loan help

Are overdraft and cash credit accounts treated differently?

Yes. Cash credit and overdraft accounts are tested on whether the balance stays above the limit or drawing power, not on missed instalments. Ask your bank how it has classified your account, because this affects when it becomes an NPA and what the bank can do next.

Debt relief options questions

How settlement compares with restructuring, consolidation and other routes.

What is debt relief in India?

Debt relief is any legal way of making debt you cannot manage easier to repay or close. In India, it usually means restructuring, consolidation, a one-time settlement with the lender, or Lok Adalat. There is no general government waiver for personal loans or credit cards.

Debt relief options in India

Is debt consolidation better than loan settlement?

If you can still pay and qualify, consolidation is usually better, because you repay in full and protect your credit report. If you cannot repay and have missed EMIs, settlement may be the realistic route. Once EMIs are missed, a good consolidation loan is often unavailable.

Debt consolidation vs settlement

Is restructuring better than settlement?

If you can pay a smaller EMI, restructuring is usually better, because the loan continues and it generally harms your credit less. Settlement fits when even a reduced EMI is out of reach and you can raise a lump sum. Ask your lender about restructuring first.

Settlement vs restructuring

Is loan settlement the same as a loan waiver?

No. A settlement is a private agreement in which your lender accepts less and reports the account as settled. A waiver is the lender or government writing off dues, usually under a specific scheme. There is no general waiver for personal loans or credit cards in India.

Settlement vs waiver

Is there a government scheme to waive personal loans?

No general government scheme waives personal loans or credit card dues in India. Treat anyone selling a guaranteed waiver as a warning sign. Specific schemes may exist for certain groups or sectors, so check the official source before you pay anybody or share any documents.

Scam warning signs

Can I declare bankruptcy for personal loans in India?

In practice, this is rarely used. The insolvency code's individual provisions are in force only for personal guarantors to companies, and other individuals fall under older laws. Most borrowers look at restructuring or settlement first. Take advice on your own facts before considering it.

Compare debt relief options

How do I spot a loan settlement scam?

Warning signs are a guaranteed percentage before anyone sees your papers, requests to pay the settlement into a personal or company account, promises of no CIBIL impact, and pressure to pay today with nothing in writing. Pay settlement money only to your lender, against its letter.
