The service

How business loan settlement works in India

In short: Business loan settlement is a one-time compromise in which the lender accepts less than the full outstanding to close a term loan, overdraft, cash credit or MSME facility. For secured loans, the settlement letter must also cover the release of your property or other security.

Business loan settlement works on a different footing from a personal loan. The account may be secured against stock, receivables, or property, there may be a personal guarantee attached, and once it is classified as non-performing the lender has formal recovery routes available, including the Debt Recovery Tribunal and Lok Adalat settlement camps.

Legal Savvy reviews the sanction letter, the security documents, and the guarantee position first, then builds a One-Time Settlement proposal around what the business can actually pay. Where a matter is already before a tribunal or listed for a Lok Adalat sitting, we prepare the file and appear alongside you.

What we do for you

  • Review of the sanction letter, security documents, and any personal guarantee given
  • Assessment of the account NPA classification and what recovery stage it has reached
  • One-Time Settlement proposal structured around the business actual repayment capacity
  • Representation if the matter is listed before the Debt Recovery Tribunal
  • Preparation and appearance for Lok Adalat settlement sittings where the lender agrees to refer
  • Written settlement terms and closure confirmation before any payment is released

Recovery agents crossing the line?

Calls after 7 pm, threats, calls to your family. RBI rules forbid all of it. We document it and make the lender answer for it.
