The main routes

Debt relief options compared

No single option is right for everyone, and settlement is not always the best one. Start from where you are today.

OptionSuits you whenEffect on credit scoreKeep in mind
Pay as agreed, with a budgetYou can still pay, but money is tightProtects your scoreFalling behind later costs more in interest and charges
RestructuringIncome fell, but you can pay a smaller EMIOften reported as restructured, usually less harmful than settledThe lender decides, and the total interest may rise
Consolidation or balance transferYour score is still good and income is steadyNeutral if you keep payingNew loans can be hard to get once you have missed EMIs
One-time settlementYou cannot repay in full, and can raise a lump sumReported as settled, which lowers your score for a periodGet it in writing, and pay only the lender
Lok AdalatA case is filed, or the lender sent a Lok Adalat noticeDepends on how the lender reports the closureBoth sides must agree, and you may decline the offer

Which option fits you?

SITUATION 1

You have not missed an EMI yet

Speak to your lender about restructuring early, and compare consolidation. You have the most options now, because your credit record is still clean.

SITUATION 2

You are overdue and agents are calling

Know your rights first, keep a record of every call, and list all your loans before paying any one lender. Then compare restructuring with settlement.

SITUATION 3

You have a legal notice

Do not ignore it, and do not panic. Read what it is and the deadline, because a demand notice, a cheque bounce notice and a Lok Adalat notice each need a different reply.

SITUATION 4

You cannot repay in full

Settlement may fit if you can raise a lump sum. See what you may pay, the time it could take, and what happens to your credit score afterwards.

Debt relief by type of debt

The right debt relief solution also depends on what you owe. Here is what changes for each kind of loan.

  • Personal loan debt relief

Unsecured, so there is no asset to seize without a court process. Restructuring comes first if you can still pay, and settlement if you cannot.

    Personal loan settlement
  • Credit card debt relief

Interest and late fees build quickly, so check how much is principal. Issuers may offer an EMI plan or a one-time settlement.

    Credit card settlement
  • Business debt relief

Check security, guarantors and cheques first. A plan has to protect the people who signed, as well as the business.

    Business loan settlement
  • NBFC loan relief

NBFCs have their own policies and may use arbitration, so reply to any notice on time and ask about restructuring early.

    NBFC loan settlement
  • Loan app debt relief

First find out which registered lender is behind the app. Threats or misuse of your contacts call for a complaint, not just a payment.

How to get debt relief: five steps

  1. STEP 1

    List every loan and card

Note the lender, the amount owed, the EMI and how many days overdue each one is. Most bad decisions come from looking at one loan at a time.

  2. STEP 2

Work out what you can actually pay

Start with your income, take away rent, food, school fees and medical costs, and see what is left. That figure decides which options are open to you.

  3. STEP 3

    Read every notice

Note the deadline and the type of notice. A reply can be urgent even when you have no money to pay.

  4. STEP 4

    Write to your lender

Explain your hardship with papers and ask what it can offer. Keep every request and reply in writing.

  5. STEP 5

    Get any agreement in writing

Whichever route you choose, make sure the lender's letter shows the amount and the closure before you pay. Then collect your closing papers.

When to take legal advice first

Debt settlement and other relief routes are usually simple to start, but some situations change what you should do next. Take advice before you pay anyone or stop paying if you have received a cheque bounce notice, a court summons, an arbitration notice or a SARFAESI notice on a home or property loan. The same applies if someone else signed as guarantor, or if a lender holds your cheques, gold or property papers.

These matters have deadlines, and missing one can cost you options that were open a week earlier. A short review of your papers can tell you which notice is urgent and which can wait.

Debt relief, settlement and waiver are different

Debt relief is the broad term for any route on this page.

Settlement is one route: your lender agrees in writing to accept less than you owe and close the account.

A waiver is the lender or a government writing off dues, usually under a specific scheme. There is no general waiver for personal loans or credit cards.

Also, some debt relief businesses offer only a new loan to replace the old ones. That can help if you qualify, but it is borrowing, not a reduction in what you owe.

Debt relief company, program or platform?

These words are used loosely. A debt relief company or debt relief platform may negotiate for you, sell a new loan, offer a monthly program, or simply pass your details on to someone else. So look past the label and ask three questions: what exactly will you do, what will it cost in total, and who holds my money? In a monthly program, ask whether your money is going to lenders or sitting with the company while your dues keep growing.

Four things people get told, and what is true

“A government scheme will waive my loan”

There is no general waiver for personal loans or credit cards in India. Treat anyone selling a guaranteed waiver as a warning sign.

“A company can clean my CIBIL report”

Only your lender changes what it reports, and only genuine errors can be removed through a dispute with the credit bureau.

“I will go to jail for missing EMIs”

Missing an EMI is a civil matter. Cheque bounce and fraud are different, so read any notice carefully and take advice.

“Paying a relief company clears my debt”

Your debt closes only when your lender confirms it in writing. Pay settlement money only to the lender.

Frequently asked questions

What is debt relief?

Debt relief is any legal way of making debt you cannot manage easier to repay or close. In India, that usually means restructuring, consolidation, a one-time settlement with the lender, or a Lok Adalat settlement.

Which is the best debt relief option in India?

It depends on your situation. If you can still pay a smaller EMI, restructuring usually protects your credit better. If you cannot repay in full and can raise a lump sum, settlement may fit. Compare them before you decide.

Is debt relief legal in India?

Yes. Banks and NBFCs restructure and settle loans under RBI rules and their own board-approved policies. Whichever route you use, get the terms in writing from the lender.

Does debt relief affect my CIBIL score?

Often, yes. A settled account is reported as 'Settled', which lowers your score for a period, and restructuring is also reported. The effect differs by option, so ask before you agree.

Can I get debt relief without a company?

Yes. You can write to your lender yourself. A company or legal professional can help with several lenders, legal notices or harassment.

How long does debt relief take?

It depends on the route and the lender. A restructuring request or a settlement can take from a few weeks to several months, and time to raise the money is on top. Ask your lender for timelines in writing.

Are debt relief programs safe in India?

Some are, but check the details. Ask what the program costs, who holds your money, and whether your lenders have agreed to anything. Your dues and recovery calls can continue until a lender confirms a deal in writing.

Which is the best debt relief company in India?

We believe Legal Savvy is the best debt relief company in India for borrowers who cannot repay in full. Legal experts handle your case, and you pay the settlement directly to your lender.

How do I choose a debt relief company?

Check that it is a registered company, has legal experts review your notices, and lets you pay the lender directly. Legal Savvy meets all of these, and you can compare us with anyone.

Can I declare bankruptcy for personal loans in India?

In practice, this is rarely used. The insolvency code's individual provisions are in force only for personal guarantors to companies, and other individuals fall under older insolvency laws. Take legal advice if you are considering it.
