If a loan is not paid, it becomes an NPA after 90 days, recovery and legal steps can follow within the first year, and the record stays on your credit report for years. The debt does not simply vanish after 3 years. The 3-year rule limits when a lender may file a civil money suit, and it can restart. This guide is for borrowers with an old unpaid loan who want to know what happens at each stage, and what their options are now.
What happens if a loan is not paid? The timeline
| Time overdue | What usually happens | What you can do |
|---|---|---|
| Up to 30 days (SMA-0) | Reminders, bounce charges, late fees | Pay up or ask for a short extension |
| 31 to 60 days (SMA-1) | More calls, messages, first letters | Ask about restructuring |
| 61 to 90 days (SMA-2) | Collection teams, stronger notices | Write to the lender about your hardship |
| After 90 days (NPA) | Account classed as NPA, recovery steps and legal review | Start settlement talks if you cannot repay |
| About 1 year | Legal notice, arbitration, Lok Adalat or agency recovery | Reply to every notice in time |
| About 3 years | Limitation question arises for a civil money suit | Check dates before signing or paying |
| 4 years and beyond | Calls may continue, the record may remain, a sale of the debt is possible | Get your papers reviewed, then decide |
These are typical patterns, not fixed dates. Lenders move at their own pace, and a secured loan can follow a different route. Banks may also write off a loan in their books, but that is an accounting step. It does not mean you no longer owe the money.
After 90 days: your loan becomes an NPA
RBI's norms class a loan as a non-performing asset when interest or principal has stayed overdue for more than 90 days. The status is set by the lender's end-of-day process, so one late payment can move you between stages. After this point, your account moves from reminders to recovery. For a home or other secured loan, the lender may start action under the SARFAESI Act, with a notice under Section 13(2) giving you 60 days. Our guide on NPA loan settlement explains this stage in detail.
Loan not paid for 1 year
By the end of the first year, most lenders have passed the file to a collections team or an agency, and may have started legal steps. You might receive a legal notice, an arbitration notice, a Lok Adalat notice or, if a cheque or mandate bounced, a notice under Section 138 or Section 25. A lender can also file in a Debts Recovery Tribunal for larger amounts of ₹20 lakh or more. A notice is not a court order. Most can be answered, and many deadlines are short, so do not ignore them. Check first that the notice is real, since fake summons are common.
Loan not paid for 3 years: the limitation rule explained
Under the Limitation Act, 1963, a suit to recover money generally has to be filed within 3 years. This is the part people misunderstand. It sets a time limit on going to court. It does not cancel what you owe, and your lender may still ask you to pay.
When does the 3 years start?
This depends on the loan's terms. It is often tied to when a payment fell due, or when the loan was recalled. The date is not always the date you stopped paying, so read your agreement and letters.
How can the 3 years restart?
- A written, signed acknowledgement of the debt, made before the period ends (Section 18).
- A part-payment made before the period ends, where the fact of payment appears in the writing of the person paying (Section 19).
- A settlement proposal, email or letter can sometimes count as an acknowledgement. Be careful what you sign or write.
Limits of the limitation rule
A secured loan can have longer periods for enforcing the security. Legal proceedings started in time can continue well after 3 years, and a decree has its own time limit. Courts decide limitation on the facts of each case, so nobody can safely tell you a debt is time-barred without seeing the papers. Treat any online promise that your loan has 'expired' with caution, including this general guide, and have your documents reviewed.
Loan not paid for 4 years and beyond
After 4 years, some accounts go quiet, while others are sold to an asset reconstruction company (ARC) or passed to a new agency. If a new company contacts you, ask for proof that it now holds the debt, along with a statement of what is claimed. Even where a civil suit may be out of time, recovery calls can continue, as long as they stay within RBI's conduct rules. Nobody may threaten, abuse or shame you at any stage.
What about your CIBIL record?
Credit bureaus keep a history of your repayment, so an old default keeps showing for years, and it counts against you in new applications. Limitation does not remove it. A later settlement changes the status to 'Settled', and paying in full changes it to 'Closed'. If a detail is wrong, you can dispute it with the bureau, but true history stays. Do not pay anyone who promises to delete it.
Can you go to jail for an unpaid loan?
Not paying a loan is generally a civil matter, not a crime. Criminal cases can arise in specific situations, such as a bounced cheque or mandate where the notice steps are followed, or fraud. Ignoring a court summons can also lead to a warrant. Agents who say 'the police will come tomorrow' over an ordinary default are usually trying to frighten you. Read our guide on whether you can go to jail for not paying a loan.
What to do now if your loan is years overdue
- 1Collect your loan agreement, last statements and every notice, and note when you last paid.
- 2Get your credit report, and check how each account is reported.
- 3Do not sign anything, or make a token payment, until you understand its effect on the limitation clock.
- 4Reply to any genuine notice before its deadline.
- 5If you can repay, close the loan. If you cannot, look at settling it for a written, final amount.
- 6Pay only through the lender's official channel, and collect a No-Dues Certificate at the end.

Frequently asked questions
What happens if a loan is not paid for 3 years?
A civil suit to recover money generally has to be filed within 3 years, but the debt is not erased. The period can restart through a written acknowledgement or part-payment. Your credit report still shows the default.
Is a loan cancelled after 3 years in India?
No. Limitation affects when a lender can sue, not whether you owe the money. Lenders may still ask for payment, and proceedings started in time can continue. Have your dates checked before assuming anything.
Loan not paid for 4 years: can the bank still take action?
It depends on your dates, acknowledgements, payments and security. Cases filed in time can continue, secured loans can have longer periods, and calls may continue. Recovery must always stay within RBI's conduct rules.
Can a part-payment restart the limitation period?
It can, if made before the period ends and the payment appears in the writing of the person paying, under Section 19 of the Limitation Act. Get advice on an old loan before making a small token payment.
What is the time limit for loan recovery in India?
Generally 3 years for a civil money suit, subject to restarts, with different periods for secured rights and decrees. Recovery calls are not themselves a court case, but they must follow RBI's rules.
