EMI not paid and phone locked? Your rights under RBI's new rules

9 min · Raj · Anti-Harassment

EMI not paid and phone locked? A lender may restrict a phone only in limited cases. Under the RBI Directions dated 6 August 2026, which apply from 1 January 2027, restriction is allowed only where that same device was bought with that lender's loan, the loan agreement clearly allows it, and notice has been given. A lender has no such right over a phone you bought yourself. This guide is for anyone facing a locked phone today, and covers which loans the rule covers and how to get a device unlocked.

Can a lender lock my phone if I miss an EMI?

Only if that phone was financed by that lender, and only under conditions. A loan for a phone bought on EMI at a shop is the usual case. A personal loan, credit card or loan app dues give the lender no right to disable your device. The new RBI Directions were issued on 6 August 2026 and apply from 1 January 2027. Until then, your loan agreement and the existing rules on fair recovery conduct apply, and threats or abuse are not allowed at any time.

We read this rule through published legal summaries of the Directions, not only news reports, because the May 2026 draft had different day counts. If a lender quotes a different number to you, ask for the exact clause in writing.

Phone bought with cash or a different loanNo, not by this lenderComplain to the lender in writing

What must a lender do before locking a device?

  1. 1The loan agreement must clearly allow the restriction and set out how it works.
  2. 2You must get notice, as the agreement says, with details of the steps it will take.
  3. 3Restriction must be gradual, and cannot start before the loan is 30 days past due.
  4. 4Full restriction, including outgoing calls, cannot start before 60 days past due.
  5. 5You must be able to see the status of the restriction.

What must keep working on a restricted phone?

Summaries of the Directions agree that incoming calls and emergency SOS must keep working. They differ slightly on the rest: one lists internet access too, and another lists SMS. Whichever applies to your lender's version, a restriction may not be used to cut you off from emergency help. The lender and its technology provider are also barred from accessing or using your device data, including contacts and photos, for recovery or anything else.

What should I do if my phone is locked today?

  1. 1Take a photo of the lock screen with a second phone, including any message or number shown.
  2. 2Find out which lender financed the phone. Check your invoice and loan agreement.
  3. 3If this lender did not finance it, tell them in writing that the restriction has no basis, and ask them to remove it.
  4. 4If it did, ask for your dues statement, the notices it says it sent and the clause it relies on.
  5. 5If you can pay the overdue amount, pay only through the lender's official channel, and keep the receipt.
  6. 6Write down the time you paid. The restoration clock runs from when the money reaches the lender.
  7. 7If anyone asks for money to a personal UPI ID to unlock the phone, do not pay it.

How to get a phone unlocked after paying

As reported, the lender must reverse the restriction within one hour of receiving your dues. If it is late, or if the restriction was wrong in the first place, the lender must pay ₹250 for each hour, up to the loan amount. Legal commentators note it is not yet clear whether this means every hour or only working hours. Once the loan is fully repaid, the mechanism must be removed from your device. Do not factory-reset or try to bypass a lender's lock yourself before checking your agreement, because it may breach the agreement and can cause data loss.

Where to complain about a locked phone

  1. 1Write to the lender's grievance officer. The new rules require a mechanism for unlocking complaints, so ask for the details.
  2. 2Quote your loan number, the date and time of the lock and of your payment, and attach proof.
  3. 3If it is not resolved in 30 days, or you get an unsatisfactory reply, file at the RBI's Complaint Management System within 90 days of the lender's reply, at cms.rbi.org.in.
  4. 4If an unknown app took control of your phone, or anyone threatens to leak your data, report it at cybercrime.gov.in or call 1930.
  5. 5In an immediate threat, call 112.

What if a loan app has control of my phone?

Many loan apps ask for access to contacts, photos and your location when you install them. That is not the same as a right to restrict your phone. Go to your phone's settings, remove the app's permissions, and uninstall it if you can. Take screenshots first, since they are evidence. Then check whether the app is linked to an RBI-regulated lender. Our guide on loan app harassment explains the complaint steps, and our legal experts can review your case if you are getting threats.

Does a locked phone mean you still owe the loan?

Yes. Winning a complaint about a wrong lock can bring compensation, but it does not cancel your dues. If you cannot pay, deal with the debt too. Ask about reduced EMIs if your problem is short-term, or look at settlement if you cannot repay at all. For a phone loan, the amount may be small enough to clear quickly, which ends the problem. Conclusion: check whose loan bought the phone

If your EMI is not paid and your phone is locked, the first question is whether that lender financed that phone. If it did not, the lock has no basis. If it did, the conditions above apply, and from 1 January 2027 you have clear rights to restoration and compensation. Save the evidence, complain in writing and tell our legal experts what happened.
