Personal loan settlement percentage: how much you may pay in India

11 min · Raj · Personal Loan

As an estimate, a personal loan settlement can reduce what you owe by 65% to 80%, which means paying about 20% to 35% of the total. The actual personal loan settlement percentage varies from bank to bank and case to case, and your lender makes the final decision. This guide is for borrowers who can no longer repay in full and want to know what a settlement could cost, what moves the figure, and how to negotiate it safely.

What is a usual personal loan settlement percentage?

There is no official settlement percentage in India. The RBI does not publish one, and banks and NBFCs decide under their own board-approved policies. That is why you will see different numbers quoted online. Our working estimate at Legal Savvy is a reduction of 65% to 80% of the total owed, so a payment of about 20% to 35%. Treat that as a starting point for planning, not a promise. Some borrowers will pay more, and a lender can refuse to settle at all.

Two terms cause confusion. The settlement percentage can mean the share you pay, or the share the lender gives up, which some people call the haircut or waiver. If someone tells you '70%', ask which one they mean. Paying 30% and getting a 70% reduction are the same deal, and paying 70% is a very different one.

What changes the settlement percentage?

How overdue the account is

A lender treats an account that is 30 days late very differently from one that is a year late. Once a loan is more than 90 days overdue, it generally becomes a non-performing asset (NPA), and lenders tend to become more open to a settlement discussion after that. Before that stage, a lender may simply expect you to catch up.

Your documented hardship

A job loss, illness, a death in the family or a failed business carries more weight when you can show it. A termination letter, medical bills and bank statements do more than a phone call. Lenders want to see that you cannot pay, not just that you would prefer not to.

The lender and its policy

Each bank and NBFC sets its own approach. Under the RBI's 2023 framework, every lender must settle under a board-approved policy, and approvals sit with senior staff. This is why the same offer can be accepted by one lender and refused by another.

Lump sum or instalments

Being able to pay at once usually helps your case. Under the RBI's framework, a settlement with a payment period longer than three months is treated as a restructuring, which is one reason lenders often prefer shorter timelines. If you need time, say so early and ask for the schedule in writing.

Whether the loan is secured

Most personal loans are unsecured, so the lender has no asset to sell. A home loan or car loan is different, because the lender has other ways to recover its money. Expect secured loans to work differently from the estimate on this page.

Is it worked out on principal or the total you owe?

Always ask. Lenders may look at the principal outstanding, the total including interest and penalties, or both. On a loan with heavy charges, the difference is large. Get the breakdown from your latest statement before any discussion, and make sure the settlement letter states the exact amount that closes the account.

How to negotiate your personal loan settlement

  1. 1List every loan and card, with the amount owed and how many days overdue each one is.
  2. 2Work out what you can really pay, after rent, food, school fees and medicines.
  3. 3Collect proof of your hardship and write a short hardship letter.
  4. 4Write to the lender's collections or settlement team, and keep every reply.
  5. 5Start from what you can afford, not from what an agent demands on the phone.
  6. 6Get the offer on the lender's letterhead, showing the amount, the deadline and that the rest is closed.
  7. 7Pay only into the lender's official account, then collect your No-Dues Certificate.

Warning signs around settlement percentages

  • A guaranteed percentage before anyone has seen your papers.
  • A request to pay the settlement into a personal account or a company's account.
  • A promise that your CIBIL score will not be affected.
  • Pressure to pay today or lose the offer, with nothing in writing.

What a settlement really costs you

The percentage is only part of it. A settled account is reported as 'Settled' rather than 'Closed', which lowers your score for a period and can make new credit harder. RBI's framework also says the same lender cannot give you fresh non-farm credit for at least 12 months after a settlement. If you can still manage a reduced EMI, compare restructuring first.

Personal loan settlement rules you should know

The main rules come from the RBI's Framework for Compromise Settlements and Technical Write-offs, dated 8 June 2023. It applies to banks and NBFCs, and these are the points that matter most to a borrower.

  • Each lender must have a board-approved policy on settlements, so the decision follows that policy and not the mood of a collections agent.
  • A settlement is not automatic. You have no legal right to one, and the lender can refuse.
  • A payment period of more than three months is treated as a restructuring.
  • The same lender must wait at least 12 months before giving you fresh non-farm credit, and it may set a longer period.
  • Action for fraud or wilful default can continue despite a settlement.
  • Recovery conduct rules still apply, so nobody may threaten or abuse you while talks go on.

Documents to keep ready

A settlement discussion moves faster when your papers are in order. Lenders usually want proof of both the debt and the hardship, and you will need your own records if a figure is disputed later.

  • Your loan agreement and latest statement, showing principal, interest and charges.
  • Bank statements for the last six months.
  • PAN and Aadhaar copies.
  • Proof of hardship, such as a termination letter, medical bills or business records.
  • Every notice, letter and message you have received from the lender or its agents.

A simple way to set your target figure

Start from your own budget, not from the percentage. Say you owe ₹5 lakh and can save ₹12,000 a month after essentials, and a relative can lend you ₹50,000. In ten months you could raise about ₹1.7 lakh, which falls inside the estimated range. If your budget only reaches ₹60,000 in that time, the range tells you early that you need another plan, such as a longer timeline or talking to the lender about restructuring. This example is only arithmetic. Your lender may want a different amount or a faster payment.

If you have more than one loan

Most people in this position have several loans and cards, and cannot raise money for all of them together. Look at each one by how overdue it is, whether a notice has arrived, whether it has a cheque or mandate attached, and how aggressive the recovery is. A debt with a live legal deadline usually needs attention before a larger but quieter one. The percentage can also differ on each loan, so do not assume an offer from one lender applies to another.

A personal loan settlement percentage of about 20% to 35% is a useful planning estimate, but only your lender's written offer is real. Check your figures with the calculator, and let our legal experts review your loans before you agree to anything.
