No, recovery agents should not call your family or employer to pressure you. Under RBI's rules, loan matters are to be discussed only with the borrower or guarantor, and harassing relatives, referees, friends or co-workers is a banned practice. This guide is for borrowers whose family, referees or workplace are getting calls, and for the relatives receiving them. It explains the limits, what relatives can say, and how to stop the calls.
Can recovery agents call your family?
They should not use your family to pressure you. RBI's Directions of 6 August 2026, effective 1 January 2027, say an employee or agent shall discuss loan dues only with the borrower or guarantor. They also treat intimidating or harassing relatives, referees, friends or co-workers, or intruding on their privacy, as harsh methods that lenders must not use. Earlier RBI guidance on recovery agents already barred interfering with the privacy of family members and referees.
Being a relative does not make someone liable. A spouse, parent, child or sibling owes nothing unless they signed as co-borrower or guarantor.
Who can a recovery agent contact?
| Person | Can they be asked to pay? | What agents may do |
|---|---|---|
| Borrower | Yes | Contact within the hours and conduct rules |
| Co-borrower | Yes, as agreed in the loan | Contact within the hours and conduct rules |
| Guarantor | Yes, under the guarantee | Contact within the hours and conduct rules |
| Spouse, parents, children (not signed) | No | Must not discuss the loan or pressure them |
| Referee named on your form | No | A referee is not a guarantor, and must not be harassed |
| Friends, neighbours, contact list | No | Must not be messaged about your debt |
| Employer or colleagues | No | Must not be told about your debt to shame you |
Can a recovery agent call your employer or HR?
Agents have no right to tell your employer about your loan to pressure you, and harassing co-workers is a listed harsh practice. A real salary deduction cannot be ordered by an agent either. It would need a court process, or a mandate you agreed to.
What to tell your office
You do not have to explain your loan. If calls reach HR, a short note often works: "A collection agency has contacted the office about a private financial matter. I am handling it with the lender. Please do not share my details, and please forward any written communication to me." Ask for the caller's number and the time of the call for your complaint.
What relatives can say when an agent calls
- "I am not a borrower or guarantor on this loan. Please do not call this number."
- "Please send anything you need to the borrower in writing."
- "Which lender and agency are you calling from? What is your name?"
- They should not confirm your address, income or location, and need not stay on the line.
How to stop recovery agents calling your family or employer
- 1Collect proof: screenshots and call logs from the people contacted, with their permission and a short signed note if possible.
- 2Email the lender's grievance redressal officer. List the numbers called, the dates and the agency, and ask for the calls to stop.
- 3If the complaint is not resolved in 30 days, file with the RBI Ombudsman at cms.rbi.org.in.
- 4If a loan app is messaging your contact list or sending edited photos, report it at cybercrime.gov.in or on 1930 straight away.
- 5If relatives are threatened, they can file their own police complaint.
Why agents have your family's numbers
Banks usually collect references on the application form. Some loan apps have also collected contact lists through phone permissions. RBI's digital lending rules restrict such access, and its 2026 Directions require lenders to limit borrower information given to agents to what the job needs, and to guard against misuse. Check and remove unneeded app permissions on your phone.
Conclusion: recovery agents should not call your family or employer
Recovery agents may pursue you and your guarantor, not your family, friends or colleagues. Save the proof, write to the lender, and escalate if the calls continue. If the pressure is reaching your home or job, our legal experts can write to the lender for you and help you work towards a written settlement of the genuine dues.
