RBI guidelines for recovery agents: timings, home visits and your rights

8 min · Legal Savvy Editorial Team · Anti-Harassment

RBI guidelines for recovery agents allow banks and NBFCs to remind you about overdue loans, but only within strict limits. Agents may contact you only between 8 am and 7 pm, must carry an ID and the lender's authorisation, and must never threaten you, abuse you or shame you before family, neighbours or colleagues. This guide explains each of these recovery agent rules in plain language, and what to do when an agent breaks them.

Where these recovery agent rules come from

RBI first issued guidelines on engaging recovery agents in 2008 and has tightened them since, most notably in its August 2022 circular on recovery agents and its directions on outsourcing and fair practices. They apply to banks, NBFCs, housing finance companies and other lenders regulated by RBI, and to the agencies and apps working for them. Loan apps are also covered by RBI's digital lending rules.

Call timings: when can recovery agents call?

Recovery agents may call or visit only between 8 am and 7 pm. Calls before 8 am or after 7 pm are not allowed, no matter how overdue the loan is. Repeated calls meant to wear you down, and calls from many different numbers, also count as harassment.

RBI guidelines for recovery agents on home visits

Recovery agents visiting home is allowed, but only within limits. Agents may visit you to discuss the overdue amount, and the visit must be decent and respectful.

  • The meeting should be at a place of your choice. If you have not named one, it can be at your home or place of work.
  • Visits are allowed only between 8 am and 7 pm.
  • Agents should avoid visits on sensitive occasions such as a death or wedding in the family.
  • They must not enter your home without permission, raise their voice, gather a crowd or use force.
  • They cannot take away your belongings for an unsecured loan. Only a secured asset, such as a vehicle, can be repossessed, and only through the process in the loan agreement and the law.

ID card and authorisation letter

The lender must tell you which agency is handling your account. Every agent must carry an identity card issued by the agency and a copy of the lender's notice or authorisation letter for your account. Ask to see both before you discuss anything. If an agent refuses, you do not have to deal with them, and you should note the details for your complaint.

Checklist: when a recovery agent visits your home

  • Check the time: visits are allowed only between 8 am and 7 pm.
  • Ask for the agent's ID card and the lender's authorisation letter, and photograph both.
  • Ask which lender and which loan account the visit is about.
  • Talk at the door or a place you choose; you do not have to let them in.
  • Do not pay cash or into a personal UPI ID; ask for the lender's official payment link or account.
  • Note the date, time, names and what was said, for any complaint.

Your rights as a borrower in loan recovery

  • The right to know which lender and which agency is contacting you.
  • The right to privacy: your debt should not be discussed with others.
  • The right to be treated with dignity, in calls, messages and visits.
  • The right to a written statement of what you owe.
  • The right to complain to the lender and then to the RBI Ombudsman.
  • The right to negotiate a repayment plan or settlement in writing.

Where to find the RBI guidelines for recovery agents (PDF)

The official text is on rbi.org.in under Notifications and Master Directions. Search for the circular on recovery agents (August 2022) and the directions on managing risks in outsourcing of financial services; each opens as a PDF you can download, print and show to the lender if its agents break the rules. RBI's Fair Practices Code for lenders and its digital lending directions cover the rest of the RBI rules for recovery agents.

What happens to lenders that break the rules?

The lender cannot pass the blame to the agency: it is responsible for the agents it engages. RBI can impose penalties on lenders, and has in the past barred some from using recovery agents in a region for a period after repeated complaints. Your complaint helps build that record.

What to do if a recovery agent breaks the rules

  1. 1Stay calm and do not hand over money to an agent in cash or to a personal UPI ID.
  2. 2Ask for the agent's ID and authorisation letter, and note their name, number and agency.
  3. 3Save screenshots, call logs and recordings.
  4. 4Complain in writing to the lender's grievance redressal officer.
  5. 5If it is not resolved in 30 days, file with the RBI Ombudsman at cms.rbi.org.in.
  6. 6Report threats, extortion or morphed photos at cybercrime.gov.in or on 1930.
