Debt settlement companies in India help borrowers who cannot repay in full negotiate a reduced, written closure with their banks and NBFCs. They do not lend you money, and they cannot force a lender to agree. This guide is for borrowers deciding whether to use one. It explains the four kinds of company you will come across, what any of them can and cannot do, how to check one before you sign, and why borrowers choose Legal Savvy.
What do debt settlement companies in India do?
A debt settlement company, also called a loan settlement company or debt relief company, works between you and your lenders. A good one reviews your loans and cards, helps you decide which lender to deal with first, prepares a written proposal with proof of your hardship, handles the back and forth, and checks the final letter before you pay. Many also help you respond to legal notices and recovery harassment.
What it does not do matters just as much. It does not pay your loan, it does not buy your debt, and hiring one does not reduce what you owe by itself. Until your lender confirms a settlement in writing, the full amount stays due, and interest, charges and recovery can continue.
The four kinds of debt relief business in India
These businesses use similar words, but they sell quite different things. Before you compare any two, work out which kind each one is.
| Type | What it does | Suits you when | Ask this |
|---|---|---|---|
| Legal expert-led settlement company | Reviews loans and notices, negotiates in writing, helps with harassment | You have notices, several lenders or heavy recovery pressure | Who actually reads my legal notices? |
| Monthly savings program | You set money aside each month, and it negotiates once enough has built up | You have no lump sum and a steady income | Who holds my savings, and what happens to my loans meanwhile? |
| Loan or consolidation marketplace | Offers a new loan that replaces your old ones | Your score is still good and you can pay a new EMI | Is this a reduction in debt, or simply a new loan? |
| Individual legal professional | Represents you in a case, such as Section 138, SARFAESI or arbitration | A case or a serious notice is already under way | Does this cover negotiating with my lender too? |
Be careful with lead-generation pages too. Some sites that look like debt relief companies simply collect your details and pass them on to others. If you cannot find a registered company name and an address, treat that as a warning.
What can a settlement company not do?
- Force a lender to accept an amount. Under the RBI's framework of 8 June 2023, each lender settles under its own board-approved policy, and it can refuse.
- Guarantee a percentage before anyone has read your papers. As an estimate, a settlement may reduce what you owe by 65% to 80%, but this varies by lender.
- Remove a true 'Settled' entry from your CIBIL report. Only your lender changes what it reports, and only genuine errors can be disputed.
- Stop every recovery call by a set date. It can help you complain and keep evidence, but it cannot promise a date.
- Make a court notice go away. Notices have their own deadlines, and these keep running while talks go on.
- Get you a government loan waiver. There is no general waiver for personal loans or credit cards in India.
Are debt settlement companies legal in India?
Yes, helping a borrower negotiate with a lender is a lawful business, and settling a loan is legal. But be clear about who regulates whom. The RBI regulates banks and NBFCs, and it does not license or rank debt settlement companies. So a company calling itself 'RBI approved' or 'RBI registered' should be asked to show exactly what it means. Whichever company you use, the settlement itself is between you and your lender.
How to check a debt settlement company before you sign
- 1Ask for the registered company name, and look it up on the Ministry of Corporate Affairs website. This shows that the company exists, not that it is good.
- 2Ask for the written agreement and read it before you go ahead. It should name the company, the service and the loans it covers.
- 3Ask who will read your notices and speak to your lenders, and how you will get updates.
- 4Ask how the settlement amount is paid. The answer must be: directly to your lender, against the lender's own letter.
- 5Ask what the company will do if a recovery agent threatens you tomorrow.
- 6Read recent reviews on independent platforms, including the one-star ones, and look for detail such as the lender's name and whether a letter was received.
Warning signs to walk away from
- A guaranteed percentage or a 'waiver' promised on the first call.
- Settlement money asked for in a personal account, a UPI ID or the company's own account.
- 'Your CIBIL score will not be affected', or an offer to clean your report.
- Being told to ignore notices or block your lender's number.
- Pressure to sign or pay today, with nothing in writing.
- Being told to stop paying EMIs, with no explanation of the charges, notices and credit damage that can follow.
Should you stop paying EMIs when you join?
Do not stop just because someone has told you to. Missed EMIs bring penal charges and credit bureau reports, a loan generally becomes an NPA after 90 days overdue, and recovery activity can increase. Some borrowers have already stopped because they truly cannot pay, and that is a different position. If you can still pay, even a reduced amount, ask your lender about restructuring first. Any company you speak to should explain these effects before you decide.
A company, or do it yourself?
| Your situation | Doing it yourself | Using a company |
|---|---|---|
| One or two lenders, no notices | Often workable. Write to the lender and keep every reply. | Optional |
| Several lenders and cards | Possible, but hard to keep track of and to prioritise | Often helpful |
| Legal notices or a case | Risky without help, because deadlines are short | Get legal experts to review the papers |
| Threats or heavy recovery calls | You can complain directly, in writing | Helpful for evidence and complaints |
Whichever route you take, the rules are the same: get the offer on letterhead, pay only your lender's official account, and collect the settlement letter and No-Dues Certificate.
What if a company takes your money and does nothing?
First write to the company, setting out what was promised, and keep the reply. If it does not resolve things, you can approach the National Consumer Helpline on 1915 and file a consumer complaint. For cheating, threats or fake documents, report at cybercrime.gov.in, call 1930, or go to the police. The RBI's complaint system covers your lender, not a private settlement company. Meanwhile, contact your lender directly to confirm what you still owe, because your loan is not closed until the lender says so in writing.

Frequently asked questions
What is a debt settlement company?
It is a business that helps borrowers who cannot repay in full negotiate a reduced, written closure with banks and NBFCs. It does not lend money or buy your debt, and your lender makes the final decision.
Are debt settlement companies legal in India?
Yes. Helping a borrower negotiate with a lender is a lawful business, and settling a loan is legal. The RBI regulates lenders, not settlement companies, so check the company's registration and agreement yourself.
Are debt settlement companies regulated by the RBI?
No. The RBI regulates banks and NBFCs, and it does not license or rank debt settlement companies. If a company claims 'RBI approval', ask it to show exactly what that means.
Can a debt settlement company stop recovery calls?
It can help you record evidence and complain to the lender and the RBI's complaint system, but no honest company can promise that calls will stop on a set date. Threats can be reported to 112 or the police.
Do I need a company to settle my loan?
No. You can write to your lender directly, and with one or two lenders and no notices this often works. A company helps most with several lenders, legal notices or heavy recovery pressure.
Should I pay the settlement amount to the company?
No. Pay only into your lender's official account, against the lender's own letter. Asking for settlement money in a personal or company account is a serious warning sign.
What should I do if a settlement company cheats me?
Write to it first and keep the reply. Then use the National Consumer Helpline on 1915 and file a consumer complaint. For cheating or fake documents, report at cybercrime.gov.in, call 1930, or go to the police.
